These Terms of Service ("Terms") govern your use of CertGuard at https://certguard.co.uk. By creating an account or using our service, you agree to these Terms.

CertGuard is developed and operated by OEMDrive, registered at 10 Duncombe Street, Bletchley, Milton Keynes, MK2 2LY.

1. The service

CertGuard is a cloud-based certification and compliance tracking service for businesses. It allows you to store certificate details and documents, receive expiry reminders, and export compliance packs. We provide the platform; you are responsible for the accuracy of the information you enter.

2. Accounts

  • You must provide accurate registration information and keep your account secure.
  • You are responsible for all activity under your account.
  • You must be at least 18 years old and using the service for lawful business purposes.
  • One person per account on the Free Trial and Sole Trader plans. Small Team and Growing Business plans support multiple team members (see plan details on our pricing page).

3. Free trial and subscriptions

  • New accounts receive a 14-day free trial with no credit card required.
  • After the trial, continued use requires a paid subscription (Sole Trader, Small Team, or Growing Business).
  • Prices are shown on our website and may change with reasonable notice to existing subscribers.
  • Subscriptions renew automatically unless cancelled before the renewal date.
  • You may cancel at any time from your account or via the Stripe billing portal. Cancellation takes effect at the end of the current billing period.
  • Refunds are handled in accordance with UK consumer law. Contact us if you believe you are entitled to a refund.

4. Acceptable use

You agree not to:

  • Use the service for any unlawful purpose
  • Upload malicious files or content that infringes third-party rights
  • Attempt to access other users' data or compromise our systems
  • Resell or redistribute the service without written permission
  • Use automated tools to scrape or overload the service

5. Your content

You retain ownership of certificates and documents you upload. You grant us a limited licence to store, process, and display your content solely to provide the service (including generating PDF exports and sending reminders).

6. Our responsibilities and limitations

  • We aim to keep CertGuard available and secure but do not guarantee uninterrupted access.
  • CertGuard is a record-keeping and reminder tool. We do not verify the authenticity of uploaded certificates or provide legal or compliance advice.
  • You remain solely responsible for meeting your trade's regulatory requirements and renewal deadlines.
  • To the fullest extent permitted by law, our liability is limited to the amount you paid us in the 12 months before the claim arose.
  • Nothing in these Terms excludes liability for death, personal injury caused by negligence, fraud, or any liability that cannot be excluded under UK law.

7. Data protection and privacy

Our use of your personal data is described in our Privacy Policy and Cookie Policy. By creating an account, you confirm you have read those policies.

Where you upload personal data about employees or subcontractors (for example cert holder names), you are responsible for having a lawful basis to share that information with us and for informing those individuals as required by UK GDPR, EU GDPR, or applicable local law.

8. Intellectual property

The CertGuard name, logo, website, software, and design are owned by OEMDrive or its licensors. You may not copy or reuse them without permission.

9. Termination

You may delete your account at any time from Account Settings. We may suspend or terminate accounts that violate these Terms. On termination, your data will be deleted in accordance with our Privacy Policy.

10. Changes

We may update these Terms. We will notify account holders of material changes by email or in-app notice. Continued use after changes constitutes acceptance.

11. Governing law

These Terms are governed by the laws of England and Wales. Disputes are subject to the exclusive jurisdiction of the courts of England and Wales.
